Filing 9 ORDER : Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The Court orders the trust fund officer at Plaintiffs place of incarceration to deduct $5.50 from Plaintiff's account for payment to the Clerk as an initial partial payment of the filing fee, and to continue making monthly deductions in accordance with this order. The Clerk is directed to send a copy of this order to the trust fund officer at FCI McDowell. Plaintiff's complaint #1 is dismissed because it fails to state a claim upon which relief may be granted and is legally frivolous. The dismissal counts as one of Plaintiff's three allotted dismissals under 28 U.S.C. 1915(g). To the extent that Plaintiff seeks to challenge his conviction, the dismissal is without prejudice to his ability to bring another civil rights lawsuit under 42 U.S.C. 1983 if and when his conviction is invalidated and his ability to ask the Seventh Circuit for leave to file another motion for relief under 28 U.S.C. 2255 in a proper judicial district.
