Filing 7 ORDER: Plaintiff Brian Harris' renewed application for leave to proceed in forma pauperis #6 is granted. The Court orders the trust fund officer at Harris' place of confinement to deduct $43.17 from Harris' account for payment to the Clerk as an initial partial payment of the filing fee, and to continue making monthly deductions in accordance with this order. The Clerk is directed to send a copy of this order electronically to the Supervisor of the Inmate Trust Fund Accounts at the Cook County Jail. Summonses, however, shall not issue at this time as the Court dismisses Harris' complaint #1 . Harris is granted until August 2, 2019, to submit an amended complaint and a completed USM-285 (Marshals service) form for each Defendant named in the amended complaint if he believes he can address the concerns discussed in this order. If he does not do so, the Court will dismiss this case for failure to state a claim. Harris is advised that he must promptly submit a change-of-address notification if he is released or transferred to another facility. If he does not keep the Clerk apprised of his correct address, this case may be dismissed. The Clerk is directed to send Harris an amended civil rights complaint form and instructions, a blank USM-285 form, and a copy of this order. Signed by the Honorable John J. Tharp, Jr on 6/28/2019. Filing 6 APPLICATION by Plaintiff Brian Harris for leave to proceed in forma pauperis (Exhibit). (Envelope not postmarked) (tt, ) |
Filing 5 ORDER: Plaintiffs application for leave to proceed in forma pauperis #3 is denied without prejudice. Plaintiff must either: (1) pay the full statutory filing fee of $400; or (2) submit a signed and certified renewed in forma pauperis application that attaches trust fund ledgers from approximately September 21, 2018, to the present. Plaintiffs motion for attorney representation #4 is denied without prejudice as it is too early to determine if recruitment of counsel is warranted. If Plaintiff fails to address his fee status by May 17, 2019, the Court will summarily dismiss this lawsuit. The Clerk is directed to send a blank application to proceed in forma pauperis and a copy of this order to Plaintiff. Signed by the Honorable John J. Tharp, Jr on 4/16/2019. Mailed notice (nsf, ) |
