June 10, 2019 Filing 25 MINUTE entry before the Honorable Mary M. Rowland: Telephonic status and motion hearing held on Plaintiff's Motion to Compel #1 . During our last status, the Court learned that CCC Information Services (CCC), the subject of the subpoena at issue, was named as a defendant in the underlying action in the Western District of Washington. During today's status, the Court learned that CCC filed an Answer to the Second Amended Complaint. In light of the fact that CCC will be subject to the discovery and briefing deadlines set by the court in the Western District of Washington, this Court has determined this is an appropriate case to transfer the motion to compel under Fed. R. Civ. Pro. 45(f). The Rule allows transfer when the subpoenaed party consents or in exceptional circumstances. Having filed an Answer, CCC no longer objects to the transfer of the Motion to Compel. In any event, this Court finds the fact that CCC is now a party to the underlying litigation to be exceptional circumstances. Wultz v. Bank of China, Ltd., 304 F.R.D. 38, 46 (D.D.C 2014) ("Other courts have found exceptional circumstances warranting transferring subpoena-related motions to quash when transferring the matter is in the 'interest of judicial economy and avoiding inconsistent results.'"). The parties should continue to meet and confer on the outstanding Motion to Compel. The Motion to Compel is terminated in this court. Plaintiffs' counsel is ordered to re-file Plaintiffs' motion to compel #1 in the Western District of Washington, Lundquist v. First National Insurance Co.,18-cv-5301 action. Mailed notice. (dm, )
