Filing 9 APPLICATION by Plaintiff Ricky Allen Walker for leave to proceed in forma pauperis (Exhibits, Envelope post marked 6/24/2019) (nsf, ) |
Filing 8 ORDER: Plaintiff, formerly a detainee at the Will County Adult Detention Center, brings this pro se civil rights action under 42 U.S.C. 1983 concerning a fall he suffered while trying to access a top bunk at the jail and his subsequent medical treatment. Plaintiff has notified the court that he has been released from jail and is now in a treatment facility in Springfield for 28 days #7 . Plaintiffs application #3 shows he is unable to pre-pay the $350.00 filing fee but would instead be required to make a modest initial partial payment of $3.60. Because he has been released, however, the court directs Plaintiff to submit an updated in forma pauperis application reflecting his current financial and employment. See Robbins v. Switzer, 104 F.3d 895, 897-98 (7th Cir. 1997) (the Prison Litigation Reform Act applies if a plaintiff filed suit while incarcerated, and the plaintiff remains responsible for payment of the full filing fee). If necessary, Plaintiff may submit a separate statement explaining what means of support he will have following his release from the treatment program. Failure to comply with this order by July 15, 2019, will result in summary dismissal of this case. If Plaintiff does comply, the court will conduct an initial review of the complaint #1 . Plaintiffs motion for attorney representation #4 is denied without prejudice because Plaintiff has not demonstrated that he has made any attempts to obtain counsel on his own. See Pruitt v. Mote, 503 F.3d 647, 654-55 (7th Cir. 2007) (en banc); Russell v. Bukowski, 608 F.App'x 426, 428 (7th Cir. 2015) ("[B]efore a district court is required to consider recruiting counsel to assist a litigant in a civil case, the litigant must make a reasonable attempt to secure counsel for himself."). Because Plaintiff expects to be at his Joliet home by July 1, 2019, the Clerk is directed to mail a copy of this order and a blank in forma pauperis application both to Plaintiffs current address, as reflected on the docket, and 314 S. Joliet St., Joliet, IL 60436. Signed by the Honorable Rebecca R. Pallmeyer on 6/14/2019. Mailed notice (nsf, ) Modified on 6/17/2019 (nsf, ). |
