Filing 5 ORDER: Plaintiff's application for leave to proceed in forma pauperis [#3] is granted. The Court authorizes and orders the trust fund officer at Plaintiff's place of incarceration to deduct $2.00 from his account for payment to the Clerk of Court as an initial partial payment of the filing fee, and to continue making monthly deductions in accordance with this order. Plaintiff's trust fund officer must collect 40% of all income into his trust account until accrued filing fees are paid. However, the complaint is summarily dismissed on initial review pursuant to 28 U.S.C. 1915A for failure to state a tenable federal claim. The case is terminated. Plaintiff's motion for attorney representation [#4] is denied as moot. This is one of Plaintiff's three allotted dismissals under 28 U.S.C. 1915(g). Dismissal is without prejudice to pursuing any avenue of relief that may be available in the state court system. The Court directs the Clerk to: (1) enter final judgment; (2) send a copy of this order to the trust fund office at Plaintiff's place of confinement; and (3) mail a copy of this order to Attorney Scott Marsik / Scott Marsik Law Offices / 4112 North Cass Avenue / Westmont, Illinois 60559.
