July 15, 2019 Opinion or Order Filing 8 ORDER signed by the Honorable Matthew F. Kennelly on 7/15/2019: Jack Newson has filed a pro se complaint against Al Moran along with a motion to proceed in forma pauperis, that is, without paying the usual filing fee. For this reason, the Court has reviewed Mr. Newson's complaint to determine whether it is frivolous or fails to state a claim upon which relief may be granted. The complaint, which is one page long, alleges that Mr. Moran, an employee of the Cook County Circuit Court "messed up [Mr. Newson's] reputation in front of everybody" in a courthouse clerk's office. This does not state a viable claim under federal law. Damage to an individual's reputation caused by a government official does not, without more, violate the individual's constitutional due process rights, as the Supreme Court has held. See Paul v. Davis, 424 U.S. 693, 711-12 (1976). The Court cannot imagine any other viable federal-law claim arising from the facts that Mr. Newson has alleged. And although he conceivably might be able to assert a claim under state law, the parties are not citizens of different states, so diversity jurisdiction is lacking, see 28 U.S.C. 1332, meaning that Mr. Newson must assert any state-law claim in state court. The Court grants Mr. Newson's application to proceed in forma pauperis #4 , but denies his motion for attorney representation #5 , and directs the Clerk to enter judgment dismissing this case.
