Filing 7 ORDER: Plaintiff's stipulation of settlement #6 is stricken. If Plaintiff and Defendants have settled and seek dismissal of this case, they should jointly file a stipulation to dismiss. Plaintiff's second motion to proceed in forma pauperis (IFP) #5 is denied without prejudice to him either submitting an accurately filled out IFP application, along with an updated trust account statement and an explanation of his purchases, or prepaying the $400 filing fee. Plaintiff must comply with this order by September 6, 2019. Failure to comply will result in summary dismissal. Filing 4 ORDER: Plaintiffs in forma pauperis (IFP) application #3 is denied as incomplete. The application includes neither a completed certificate section by an authorized officer at his facility, nor a copy of his trust fund account statement for the 6-month period immediately preceding the filing of the complaint. 28 U.S.C. 1915(a)(2). To proceed with this case, Plaintiff must either pay the $400 filing fee upfront or submit a completed and signed IFP application with a copy of his trust account statement. If he is granted IFP status, he will be assessed an initial partial payment followed by monthly deductions from his prison trust account. Proceeding IFP does not waive payment of the filing fee, it simply allows an inmate to pay it with monthly deductions from his jail trust account. This requirement applies for each filing fee an inmate owes. Plaintiffs failure to comply with this order by July 22, 2019 will result in summary dismissal of this case without prejudice.
