Filing 6 ORDER: Plaintiff appears to be financially ineligible to proceed in forma pauperis but regardless, his application for leave to proceed in forma pauperis #2 is denied because he has "struck out" under 28 U.S.C. 1915(g). If Plaintiff wants to proceed with this lawsuit, he must: (1) pay the full statutory filing fee of $400; and (2) show good cause in writing why this action should not be dismissed with prejudice based on his failure to disclose his full litigation history. If Plaintiff fails to comply by 8-27-19, 2019, the Court will summarily dismiss this action. Signed by the Honorable Charles R. Norgle, Sr on 7/15/2019. Mailed notice. (sxb, ) |

TEXT ORDER: Plaintiff, proceeding pro se from his incarceration in Dixon Correctional Center, has filed a complaint in the Central District of Illinois. Venue for federal civil rights actions brought under 42 U.S.C. 1983 is governed by 28 U.S.C. 1391(b). According to that statute, such actions may be brought in (1) the judicial district where any defendant resides (if all defendants reside in the same State), (2) a judicial district in which a substantial part of the events or omissions giving rise to the claim occurred, or (3) a judicial district in which any defendant may be found, if there is no district in which the action may otherwise be brought. It appears that a substantial part of the alleged events or omissions giving rise to the claims in this lawsuit occurred or are occurring in Dixon Correctional Center. Dixon Correctional Center is in Lee County, which is situated in the federal judicial district for the Northern District of Illinois. 28 U.S.C. 93. The court therefore finds that the most appropriate venue over this proceeding is in the Northern District of Illinois, and that it is in the interests of justice that this cause be transferred there. See 28 U.S.C. 1404(a). No summons shall issue in this action unless directed by the transferee court. The clerk is directed to transfer this case to the Northern District of Illinois. Entered by Judge Colin Stirling Bruce on 6/4/2019. (MAS, ilcd) Modified on 6/17/2019 (MAS, ilcd). [Transferred from Illinois Central on 6/17/2019.] |
