| Filing 15 MINUTE entry before the Honorable John Robert Blakey: Plaintiff's application for leave to proceed in forma pauperis #3 is denied because it is unsigned and also because his complaint is frivolous. This is at least the third time Plaintiff has attempted to raise the same allegations. See Simmons v. Illinois Bell, Case No. 17-cv-01230 #3 (N.D. Ill.); Simmons v. Illinois Bell Telephone Co., Case No. 17-cv-05899 #1 (N.D. Ill.). Judges in this district rejected Plaintiff's first two attempts, see Simmons, No. 17-cv-01230 #11 (dismissal order entered 3/30/17); Simmons, No. 17-cv-05899 55 (dismissal order entered 2/22/18), and this Court does so as well. As Plaintiff well knows from the first two decisions, his allegations are frivolous. In dismissing his last lawsuit with prejudice, Judge Pallmeyer warned Plaintiff that "any further frivolous litigation will result in a filing restriction." Simmons, No. 17 C 5899, 55 (order entered 2/22/18). The Court thus refers the matter to the Executive Committee for consideration of whether such a restriction should be imposed. Plaintiff's motion for attorney representation #5 is denied. Plaintiff's complaint is dismissed, and this case is closed. Civil case terminated. Mailed notice (gel, ) |
