SUMMONS Issued, certified copy of order dated 7/12/2019 to the U.S. Marshal's Office for service as to Defendant Maryville Academy via email. (ek, ) |
Filing 9 ORDER: Before the Court is Plaintiff LaShonda McBride's application for leave to proceed in forma pauperis #4 , motion for attorney representation #5 , and complaint for initial review. For the reasons set forth below, Plaintiff's application for leave to proceed in forma pauperis #4 is granted. Plaintiff's motion for attorney representation #5 is denied without prejudice. The Clerk of Court is directed to change the caption to reflect that Maryville Academy is the proper Defendant. Summons as to that Defendant shall issue. The Court directs the U.S. Marshal's office to effect service of Plaintiff's complaint on Defendant. The Court advises Plaintiff that a USM-285 (Marshals service) form is required for service on Defendant. Although Plaintiff already has submitted a USM 285 form with respect to Catherine Ryan, as discussed below, she is not a proper defendant in this employment discrimination action. Plaintiff therefore must submit a completed USM 285 form for service on Defendant Maryville Academy. The Marshal will not attempt to serve Defendant unless and until the required form is received. Plaintiff is given until August 16, 2019 to submit the required form. Failure to do so by that date may result in dismissal of this case. Signed by the Honorable Robert M. Dow, Jr on 7/12/2019. Mailed notice. (ek, ) |
