Filing 6 ORDER: Plaintiff's application for leave to proceed in forma pauperis #4 is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration to immediately deduct $16.40 from his account for payment to the Clerk of Court as an initial partial payment of the filing fee in this case. The Court also orders Plaintiff to pay (and the facility having custody of him to automatically collect and remit) to the Clerk of Court 60% of any and all deposits to Plaintiff's account until his filing fees have been paid in full. For the reasons stated below, all claims are dismissed except for those against Defendant Avila. The Court directs the Clerk to: (1) send a copy of this order (electronically if possible) to the trust fund officer at the facility having custody of Plaintiff; (2) file the complaint #1 ; (3) issue summons for service of the complaint on Defendant Avila by the U.S. Marshals Service; (4) revise the docket to reflect Avila as the lead defendant; (5) terminate all remaining defendants; and (6) send Plaintiff a blank USM-285 form, a magistrate judge consent form, filing instructions, and a copy of this order. Plaintiff has until 9/19/2019 to complete and return a USM-285 form for service on Defendant Avila. Failure to comply will result in the summary dismissal of this case. Plaintiff also must promptly submit a change-of-address notification if he is transferred to another facility or released; failure to comply will result in the summary dismissal of this case.
