Leinenweber: The Court amends its July 15, 2019 Order, denying Plaintiff Woods's Application for leave to Proceed in Forma Pauperis #4 and dismissing her complaint #1 . Under Federal Rule of Civil Procedure 60(a), a district court can "correct a clerical mistake or a mistake arising from oversight or omission whenever one is found in a judgment." The Court mistakenly found Plaintiff Woods's Application untimely, asserting that her case was filed 91 days after she received her EEOC Notice to sue. Her Complaint was filed on July 9, 2019, which is 90 days after she received her EEOC Notice. Therefore, her Application is timely. Plaintiff Woods's Application to Proceed in Forma Pauperis is thus granted and her Complaint is reinstated. Mailed notice(maf)
