September 3, 2019 Opinion or Order Filing 12 MINUTE entry before the Honorable Edmond E. Chang: Status hearing held. Defendant's answer or response (or both) to the complaint is due on 09/09/2019. Defendant will be filing, at least, a partial motion to dismiss the Section 1983 claim. Plaintiff's response to the partial motion to dismiss due 10/09/2019. Defendant's reply due 10/23/2019. The Court discussed how the Section 1983 claim might not materially impact the litigation in light of the Title VII claim and its fee-shifting provision (the compensatory damages cap, if any, might be the only difference). Mandatory Initial Discovery Pilot Project disclosures due 10/09/2019 on the non-targeted claims. ESI discovery shall be disclosed by 11/18/2019. The first-round of written discovery requests must be issued no later than 10/31/2019. Fact discovery, including treating physicians (Rule 26(a)(2)(C) disclosures for any treaters are due no later than 90 days before the close of fact discovery), shall close by 02/14/2020. Any other Rule 26(a)(2) expert disclosures (whether retained or not) are due 30 days after the close of fact discovery, and the 30-day deadline is adjusted automatically if the close of fact discovery is adjusted. No summary judgment motions may be filed before the close of discovery without leave of Court. The parties may start issuing non-party subpoenas immediately, especially for medical records. The parties shall work promptly on an agreed HIPAA order and discovery confidentiality order. Plaintiff shall make a formal settlement demand by 09/20/2019 on Defendant, explaining in detail the basis for liability, itemizing damages, and making a good-faith demand that takes into account the risks of litigation, the time and expense of litigation. Defendant shall respond by 10/01/2019 to Plaintiff's demand, explaining in detail the basis for Defendant's offer and taking into account the same risks and costs of litigation. Defendant shall submit a.pdf copy of both the demand and the offer to chambers through the Proposed Order e-mail account.
