July 9, 2020 Opinion or Order Filing 36 ORDER. Plaintiff Saturnino Gomez Perez, described by his attorney as "an elderly, low income dishwasher and food preparer," brought a wage and hour claim against his former employer, Defendant Albany Restaurant, Inc., and its owners. He settled and compromised his claim earlier this year on the understanding that he would be paid in full by the end of April 2020. Plaintiff has been patient in awaiting payment in light of the pandemic and its presumed effect on Defendant's business. He notes, however, that Defendant has remained in operation during the pandemic and has offered no documentary evidence of its claimed inability to make prompt payment. Mr. Gomez Perez is entitled to judgment in his favor.Judgment is entered in favor of Plaintiff and against Defendants in the amount of the unpaid settlement, $69,000.00.
