Date Filed Document Text
August 28, 2019 Opinion or Order Filing 11 ORDER: On August 6, 2019, the Court dismissed this case for Plaintiff's failure (despite repeated warnings of the necessity) to disclose his litigation history and his accumulation of three dismissals within the meaning of 28 U.S.C. 1915(g) #7 ; judgment entered that day. #9 Plaintiff has now submitted a "response to judgment" #10 , dated August 14, 2019, just eight days after the dismissal, in which he acknowledges the judgment but states that he had not yet received a copy of the dismissal order; he also indicates his "belie[f]" that Defendants should be "compel[led]" to respond to the complaint. As this case was dismissed for Plaintiffs non-disclosure of his pertinent litigation history, Defendants were not directed to respond. The dismissal order, moreover, was sent to Plaintiff at his address of record at the Cook County Jail. Although Plaintiff's factual recitation is confusing, it appears likely that Plaintiff simply had not yet received his copy of that order when he drafted his letter. The Clerk of Court is directed to resend to Plaintiff a copy of the dismissal order of August 6, 2019 #7 , along with a copy of the docket. Plaintiff is not, however, entitled to free copies of items he has submitted; his request for copies of his application seeking leave to proceed in forma pauperis #3 and USM-285 service forms 6 , his request is referred to the Clerk of Court for invoicing and processing. Any further requested relief is denied. This case remains closed. Signed by the Honorable Ruben Castillo on 8/28/2019. Mailed notice. (mma, )

August 6, 2019 Opinion or Order Filing 7 ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is denied, and his complaint #1 is dismissed with prejudice for his failure to disclose his litigation history and accumulation of three strikes. Lesza, 181 F.3d 857, 859 (7th Cir. 1999). An order providing instruction for the collection of Plaintiff's outstanding filing fees will follow.
