August 29, 2019 Opinion or Order Filing 12 MINUTE entry before the Honorable Gary Feinerman:Motion for leave to proceed in forma pauperis #11 is granted. The U.S. Marshals Service is appointed to serve summons 7 on Defendant using the address information on the summons. Motion for appointment of counsel #5 is denied without prejudice. The motion is denied as premature because Plaintiff "filed his motion so early in the case that it was impossible to tell whether he could represent himself adequately." Pickett v. CTA, No. 18-2785 (7th Cir. July 17, 2019), slip op. at 4; see also Romanelli v. Suliene, 615 F.3d 847, 851 (7th Cir. 2010). In addition, although Plaintiff contacted several attorneys, he did not explain "why [the attorneys he contacted] declined to represent him" in this case on a contingent fee basis. Id., slip op. at 3. "[P]erhaps" it was that "they deemed [Plaintiff's] claim too weak to justify litigation." Id., slip op. at 4. Without further detail, the court cannot determine whether this is a situation where it is being urged to "ask lawyers to devote less of their time to people with strong cases and more to [a person] with [a] weak one[]." Ibid. Finally, Plaintiff's complaint #1 is competently composed, indicating that Plaintiff, who has some college education, is capable of handling this case at this stage of the case.
