July 23, 2019 Filing 1 EXECUTIVE COMMITTEE ORDER: On January 9, 2014, the Seventh Circuit imposed a requirement that the Clerks of the District Courts in the Seventh Circuit must return unfiled Bobby Ford's submissions. USCA No. 13-2997. The ban does not apply to "criminal cases or petitions challenging the terms of his confinement...."Id.at 2 (citing Support Systems Int'l Inc. v. Mack, 45 F.3d 185, 186-87 (7th Cir. 1995) (per curiam). The exception for petitions that challenge the "terms of confinement" comprises applications for habeas corpus. See Mack, 45 F.3d at 186 ("We make an exception for any criminal case in which Mack is a defendant and for any application for habeas corpus that he may wish to file.") In January 2019, Bobby Ford submitted a proposed complaint. The Executive Committee returned it to him unfiled under the Seventh Circuit's no-filing order. In a letter dated May 10, 2019, Ford argued that the January 2019 complaint challenges the "terms of confinement." On a second review of the proposed complaint, the Executive Committee again will return the complaint unfiled (it is only being filed on this docket to preserve a record). The complaint alleges a myriad of facts that, on the surface, assert that the Illinois Prisoner Review Board has wrongly revoked Ford's parole. But the complaint also contains extensive allegations of false arrest and fabrication of evidence that does not originate with the Prisoner Review Board. And, most importantly, the complaint seeks monetary relief from a slew of individuals. Compl. at 8. Monetary relief is not available in genuine habeas petitions. If Ford wishes to submit a qualifying habeas petition, he must name only the Warden of the prison as the respondent, use the form for habeas petitions, and explain specifically how his custody is unconstitutional. Nothing in this order shall be construed ----- a) to affect Mr. Ford's ability to defend himself in any criminal action, b) to deny Mr. Ford access to the federal courts through the filing of a petition for a writ of habeas corpus or other extraordinary writ, or c) to deny Mr. Ford access to the United States Court of Appeals or the United States Supreme Court. IT IS HEREBY ORDERED That any password issued to Bobby Ford for access to the electronic filing system shall be disabled. IT IS FURTHER ORDERED That any new complaints filed by Mr. Ford and transferred to this Court from another jurisdiction shall be reviewed by the Executive Committee to determine whether they should be filed. IT IS FURTHER ORDERED That the Clerk shall cause to be created and maintained a miscellaneous file with the title "In the matter of Bobby Ford" and case number 19 C 4885. The miscellaneous file shall serve as the repository of this order and any order or minute order entered pursuant to this order. The Clerk will also maintain a miscellaneous docket associated with the file. All orders retained in the file will be entered on that docket following standard docketing procedures. A brief entry will be made on the docket indicating the receipt of any materials from Mr. Ford. IT IS FURTHER ORDERED That the Clerk shall cause a copy of this order to be mailed to Mr. Ford at N-20126, Stateville correction Center, "N.R.C. Unit," P.O. Box 112, Joliet, Illinois 60434, the address given by Mr. Ford in documents received on January 25, 2019. Such mailing shall be by certified or registered mail, return receipt requested.
