Seeger: The Third Amended Consolidated Class Action Complaint states that Pilot A (19-cv-5013) and Pilot B (19-cv-5015) have opted not to pursue their claims against Boeing. (Dckt. No. #104 , at para. 15, 21) The Complaint declares that "Pilot A is replaced by Capt. Patrick James" (para. 16), and that "Pilot B is replaced by Capt. Tawanda Chieza" (para. 22). Litigation under the Federal Rules is not like tag-team wrestling. A new plaintiff cannot simply enter the case by taking the helm from a plaintiff who decides to exit the courthouse. Rule 25 governs the substitution of parties, and it provides that "the Court" may order substitution in limited circumstances, including death and incompetency. See Fed. R. Civ. P. 25(a)(1), (b); see generally Fed. R. Civ. P. 25(a)(3) ("A motion to substitute... must be served...."). Other possibilities include a transfer of interest or a change in public officials. See Fed. R. Civ. P. 25(c), (d). Plaintiffs did not file a motion, and the Complaint does not suggest that any of those situations applies here. Accordingly, the Court deems the filing to be a notice of dismissal under Rule 41(a)(1)(A)(i) because the plaintiffs in those two actions no longer wish to proceed. Pilot A v. The Boeing Company (19-cv-5013) and Pilot B v. The Boeing Company (19-cv-5015) are hereby dismissed without prejudice. If Capt. Patrick James and Capt. Tawanda Chieza seek to join this lawsuit, this Court hereby grants them leave to do so. But they must file their own actions and file a motion to reassign and consolidate, as required by the Federal Rules and the Local Rules, by February 7, 2020. Also, Paragraph 16 of the Complaint refers to the same person as "Patrick James" and "Philip James." Any new filing shall confirm the correct name of that individual. As an aside, paragraph 21 seems to suggest that "Pilot B" was a placeholder for one of "three MAX-qualified pilots," to be determined at some point in the indefinite future. Id. at para. 21. The Complaint refers to "their income," "their personal lives," "their reliance," "their identities," "their country of residence," "their fear," and "relationships with them." Perhaps the identity of "Pilot B" was in flux, or was a pseudonym for three people (perhaps Pilots B, BB, and BBB). Mailed notice. (jjr, )

Counsel discussed the Initial Status Report for Reassigned Case, the subject matter of the litigation, and Defendant's anticipated motion to dismiss. The Court hereby grants Plaintiff's Amended Motion to Reassign and Consolidate the Pilot M case, Case No. 1:19-cv-07294 (Dckt. No. #66 ), and thus denies Plaintiff's earlier Motion to Reassign and Consolidate the Pilot M case (Dckt. No. #64 ) as moot. In light of Veteran's Day, the current due date for Defendant's answer or motion to dismiss is November 12, not November 11. Defendant's counsel reported that Defendant intends to file a motion to dismiss by the current deadline (Nov. 12, 2019) despite the continued consolidation of additional cases. Defendant shall notify Plaintiffs and the Court if it needs additional time in light of the consolidation. Assuming that Defendant files a motion to dismiss on November 12, 2019, Plaintiffs shall respond by December 16, 2019, and Defendant shall reply by January 13, 2020. Under the Amended Standing Order Regarding Mandatory Initial Discovery Pilot Project, responses to the mandatory initial discovery are stayed until 30 days after Defendant files an answer under Rule 12(a). (MIDP Standing Order, 4). Counsel discussed Plaintiff X's Application to Continue to Proceed Under Pseudonyms (Dckt. No. #31 , "Plaintiff's Application"). According to the docket, it appears that Plaintiff X's "application to continue to proceed under pseudonyms" was "granted" on August 26, 2019. Dckt. No. #35 . But the next day, the Court entered an Agreed Order that purported to set a deadline for Defendant to respond to Plaintiff's Application to Continue to Proceed Under Pseudonyms. (Dckt. No. #36 ). Later, on September 24, 2019, Defendant filed an unopposed motion for an extension of time to respond to Plaintiff X's (apparently-already-granted) motion for leave to proceed anonymously (Dckt. No. #47 ). On October 3, 2019, this Court granted the motion for extra time to respond to the (apparently-already-granted) motion to proceed anonymously. (Dckt. No. #49 ). For the sake of clarity, and to avoid any confusion, Defendant should style any challenge to the use of pseudonyms as a motion, instead of a response. Given the procedural complications, this Court grants Defendant until November 18 (not November 11 see Dckt. No. #43 ) to address the issue of pseudonyms. Finally, Plaintiff's counsel reported that he would file an index of the exhibits previously filed under seal in support of Plaintiff X's Application (Dckt.
