September 26, 2019 Opinion or Order Filing 7 ORDER: Joe C. Meadows has filed a pro se complaint against the Illinois Department of Employment Security. He has also moved to proceed in forma pauperis, that is, without paying the usual filing fee, so the Court has reviewed his complaint to determine if it is frivolous or fails to state a claim upon which relief may be granted. See 28 U.S.C. 1915(e)(2). The complaint says, in its entirety, "The Dept of Employment Security made his [sic] own judgment against my case, and did not document the telephone interview with my previous employer. He added information that was not discussed in the interview." This does not appear to the Court to state a claim for violation of Mr. Meadows's federal constitutional rights, which is the only potentially viable basis for him to proceed in federal court. Specifically, Mr. Meadows says he had a hearing but the Department reached an incorrect result. This appears to be an appeal on the merits, which Mr. Meadows would have to pursue in state court after exhausting administrative remedies. The Court concludes that the complaint fails to state a claim and therefore dismisses it. Unless Mr. Meadows files, by 10/11/2019, a proposed amended complaint that states a viable federal claim over which the Court has jurisdiction, the Court will enter judgment dismissing his case.
