Filing 9 ORDER: The Court grants Plaintiff's first application for leave to proceed in forma pauperis #3 , and denies his second application #7 as moot. The Court orders the trust fund officer at Plaintiff's place of incarceration to deduct $6.50 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee and to continue making monthly deductions in accordance with this Order. The Court directs the Clerk of Court to (1) send (electronically if possible) a copy of this Order to the trust fund officer at Plaintiff's current place of incarceration and to the Court's Fiscal Department; (2) send a copy of this Order to Plaintiff, Attorney La Porte, the Systems Department of the Northern District of Illinois, and the PACER Service Center at pacer@psc.uscourts.gov, and send Plaintiff's counsel two blank USM-285 (Marshals service) form and a magistrate judge consent form; (3) strike Plaintiff's original complaint #1 ; (4) file Plaintiff's Amended Complaint #6 ; (5) issue summonses for service of the complaint on Defendants Mohammad and Helehen by the U.S. Marshal; and (6) terminate Defendant Guyton from this action. The Court appoints the U.S. Marshal to serve Defendants. The Court grants Plaintiff's motions for attorney representation #4 , #8 . The Court recruits Michael R. La Porte, Flachsbart & Greenspoon, LLC, 333 N. Michigan Ave., 27th Floor, Chicago, IL 60601, mrl@fg-law.com, to represent Plaintiff in accordance with counsel's trial bar obligations under N.D. Ill. Local Rules 83.11(h) and 83.37. The Court sets a status hearing for December 10, 2019 at 9:30 a.m., at which time counsel should advise the Court whether he intends to file an amended complaint or proceed with the complaint on file. If counsel believes that filing an amended complaint or proceeding with the complaint on file would be inconsistent with his Rule 11 obligations, he should so inform the Court. Recruited counsel falls within the class of users listed in the Electronic Public Access fee schedule adopted by the Judicial Conference of the United States, therefore, counsel shall be exempt from the payment of fees for access via PACER to the electronic case files maintained in this court for the above- captioned case and the other case filed in this court by this Plaintiff (19 C 6247) only. Counsel should open a separate PACER account for use in this case only. Fees are exempt for this case and the previously identified cases filed in this court by this Plaintiff only; counsel shall not be exempt from the payment of fees incurred in connection with other uses of the PACER system in this court. This exemption is valid immediately and for the duration of counsel's participation in this matter. The Court may revoke this exemption at the discretion of the Court at any time. Counsel shall contact the PACER Service Center at 1-800-676 6856 or via the link below to create a new PACER account and to make any necessary arrangements for the waiver.
