October 21, 2019 Filing 16 MINUTE entry before the Honorable Edmond E. Chang: Status and motion hearing held on Plaintiffs' motion for default against Defendant Xcel, Inc. #11 . Defendant Xcel, Inc. was properly served and the time for answering the complaint has expired, so the motion for entry of default order #11 is granted. The Court finds Defendant Xcel, Inc. to be in default under Rule 55. The case remains as to Plaintiff and Defendant Rock-It-Interiors. Both sides made their MID disclosures. ESI discovery shall be disclosed by 11/14/2019. Plaintiff shall provide the audit findings promptly to Defendant. Xcel remain responsible for producing records and other discovery as promptly as if it had not defaulted. The Court invites a motion to compel if prompt compliance is nto obtained. The first round of written discovery requests must be issued by 10/28/2019, to fill gaps in the MID disclosures. Fact discovery shall close by 03/27/2020. Any Rule 26(a)(2) expert disclosures (whether retained or not) are due 30 days after the close of fact discovery, and the 30-day deadline is adjusted automatically if the close of fact discovery is adjusted.
