ORDER : Plaintiff's application for leave to proceed in forma pauperis (IFP) #3 is denied. At the time he filed his complaint, Plaintiff had over $3,000 in his prison trust fund account, and the statement of that account indicated that his average monthly receipt of funds was more than $300 during the six months just prior to filing suit. See 28 U.S.C. 1915(b); see also Sanders v. Melvin, 873 F.3d 957, 960 (7th Cir. 2017) ("[p]risoners... can save up [to] pay the filing fee"); Merritte v. Templeton, 493 F. App'x 782, 784-85 (7th Cir. 2012) (inmates who consistently receive sufficient funds, but who spend such funds at the prison's commissary usually do not qualify for IFP status). To proceed with this case, by November 15, 2019, Plaintiff must pay the $400 filing fee. His failure to comply will result in summary dismissal of this case without prejudice. See N.D. Ill. Local Rule 3.3(f). Plaintiff's motion for attorney representation #4 is denied without prejudice, as no attorney is needed to comply with this order or at this early stage of the case.
