ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration to deduct $11.13 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee. As discussed below, the Court also orders Plaintiff to pay (and the facility having custody of him to automatically collect and remit) to the Clerk of Court, 40% of any and all deposits to Plaintiff's account each time the account exceeds $10 until his filing fees have been paid in full. The Clerk of Court is directed to send a copy of this order to the trust fund officer at Plaintiff's current place of incarceration. The complaint #1 is dismissed without prejudice. Plaintiff's motion for attorney representation #4 is granted. The Court requests that David Thomas Beech Audley, Chapman & Cutler, 111 West Monroe Street, Suite 1600, Chicago, IL 60603, tel: (312) 845-3000, represent Plaintiff in accordance with counsel's trial bar obligations under the District Court's Local Rule 83.37 (N.D. Ill.). Recruited counsel falls within the class of users listed in the Electronic Public Access fee schedule adopted by the Judicial Conference of the United States, therefore, counsel shall be exempt from the payment of fees for access via PACER to the electronic case files maintained in this court for the above-captioned case and the previous case filed in this court by this plaintiff (15 CV 2941). Counsel is directed to open a separate PACER account for use in this case. Fees are exempt only for this case and the previously identified case filed in this court by this plaintiff; counsel shall not be exempt from the payment of fees incurred in connection with other uses of the PACER system in this court. This exemption is valid immediately and for the duration of counsel's participation in this matter. This exemption may be revoked at the discretion of the Court at any time. Counsel shall contact the PACER Service Center at 1-800-676 6856 or via the link below to create a new PACER account and to make any necessary arrangements for the waiver. The Clerk is directed to send a copy of this order to Plaintiff, attorney Audley, the Systems Department of the Northern District of Illinois, and the PACER Service Center at pacer@psc.uscourts.gov. Status hearing set for 12/2/2019 at 9:00 a.m. Recruited counsel should be prepared to advise the Court at the status hearing how long he will need to file an amended complaint, assuming he can do so under Civil Rule 11.
