ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration to immediately deduct $14.33 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee. As discussed below, the Court also orders Plaintiff to pay (and the facility having custody of him to automatically collect and remit) to the Clerk of Court, 40% of any and all deposits to Plaintiff's account each time the account exceeds $10 until his filing fees have been paid in full. The Clerk of Court is directed to send a copy of this order (electronically if possible) to the trust fund officer at Plaintiff's current place of incarceration. Summonses, however, shall not issue. Plaintiff's complaint #1 is dismissed without prejudice. If Plaintiff wants to proceed with this lawsuit, he must submit an amended complaint that complies with this order. Failure to submit an amended complaint by December 3, 2019, will result in summary dismissal of this lawsuit. Plaintiff also must promptly submit a change-of-address notification if he is transferred to another facility or released. Failure to keep the Court informed of his address may lead to dismissal of this action for failure to comply with a Court order and for want of prosecution. Ruling on Plaintiff's motion for attorney representation #4 is deferred. The Clerk of Court is directed to send Plaintiff an amended complaint form, a blank USM-285 form, and instructions along with a copy of this order. Signed by the Honorable John Z. Lee on 11/5/2019.
