ORDER: Plaintiff's application for leave to proceed in forma pauperis #5 is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration to deduct $12.43 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee and to continue making monthly deductions in accordance with this order. The Court directs the Clerk of Court to send a copy of this order to the trust fund officer at Plaintiff's current place of incarceration and to the Court's Fiscal Department. However, summons shall not issue. Plaintiff's complaint #1 is dismissed for failure to state a federal claim, without prejudice to Plaintiff pursuing his claims in state court. ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is denied without prejudice. If Plaintiff wants to proceed with this lawsuit, he must either (1) submit a renewed application that is signed by him, accompanied by a copy of his trust fund statements showing activity in his account or accounts for the entire six-month period immediately preceding his initiation of this action, and certified by an appropriate official; or (2) pay the full statutory filing fee of $400.00. Failure to comply with this order by November 13, 2019, will result in summary dismissal of this case. Plaintiff also must promptly submit a change-of-address notification if he is transferred to another facility or released. Failure to keep the Court informed of his address may lead to dismissal of this action for failure to comply with a Court order and for want of prosecution.
