December 5, 2019 Opinion or Order Filing 6 ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The court orders the trust fund officer at Plaintiff's place of incarceration to deduct $2.28 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee and to continue making monthly deductions in accordance with this order. The court directs the Clerk of Court to send (electronically if possible) a copy of this order to the trust fund officer at Plaintiff's current place of incarceration and to the court's Fiscal Department. Summons shall not issue at this time. and Plaintiff's complaint is dismissed without prejudice for failure to state a claim. Failure to submit a proposed amended complaint by January 10, 2020 will result in dismissal of this case. Plaintiff also must promptly submit a change-of-address notification if he is transferred to another facility or released. Plaintiff's motion for attorney representation #4 is denied without prejudice to renewal later in this case.
