Filing 5 ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration to immediately deduct $18.53 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee and to continue making monthly deductions in accordance with this order. The Court directs the Clerk of Court to send (electronically if possible) a copy of this order to the trust fund officer at Plaintiff's present place of incarceration. Summonses, however, shall not issue. Plaintiff'scomplaint #1 is dismissed without prejudice for failure to state a claim. If Plaintiff wants to proceed with this lawsuit, he must submit an amended complaint that complies with this order. Failure to submit an amended complaint by February 10,2020, will result in dismissal of this lawsuit for failure to state a claim. Plaintiff also must promptly submit a change-of-address notification if he is transferred to another facility or released. Failure to keep the Court informed of his address may lead to dismissal of this action for failure to comply with a Court order and for want of prosecution. Plaintiff's motion for attorney representation #4 , which shows that he has contacted only one attorney, is denied without prejudice to renewal should this case proceed to a point where counsel becomes necessary. Plaintiff is reminded that he must make reasonable effort to obtain counsel on his own before the Court will consider a request to recruit counsel for him.
