ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The Court orders the trust fund officer at Plaintiff's place of confinement to immediately deduct $7.33 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee in this case. As discussed below, the Court also orders Plaintiff to pay (and the facility having custody of him to automatically collect and remit) to the Clerk of Court 40% of any and all deposits to Plaintiff's account until his filing fees have been paid in full. The Court directs the Clerk of Court to send a copy of this order (electronically if possible) to the trust fund officer at the facility having custody of Plaintiff and to this court's fiscal department. For the reasons set forth below, the complaint #1 is dismissed without prejudice for failure to state a claim. If Plaintiff wants to proceed with this lawsuit, he must submit an amended complaint that states a claim against proper defendants by 2/3/2020. Failure to comply will result in the dismissal with prejudice of this lawsuit. Plaintiff's motion for attorney representation #4 , which does not reflect what attempt he has made to obtain counsel on his own, is denied without prejudice. The Clerk of Court is directed to send Plaintiff an amended complaint form, filing instructions, and a copy of this order.
