Plaintiff failed to cite legal authority in support of its request, in contravention of the Court's November 18, 2021 order #54 . The Court accordingly, for the reasons explained in Plaintiff's Agreed Motion to Extend the Date for Dismissal with Prejudice #55 , the motion is granted. November 18, 2021 Filing 54 MINUTE entry before the Honorable Franklin U. Valderrama: Before the Court is Plaintiff's unopposed motion to dismiss the case without prejudice and approve the parties' settlement #53 . While the Court finds good cause to approve the settlement agreement, the Court does not find a reason warranting dismissal without prejudice for 13 months. Plaintiff's motion is therefore granted in part and denied in part. The Court approves the settlement #52 , and the case is dismissed without prejudice. To avoid unnecessary status hearings and to provide time to effectuate the agreement, the case is dismissed without prejudice and with full leave to reinstate via motion filed by January 17, 2022. Prior to January 17, 2022, the parties can file a motion, with the appropriate authority, explaining why the Court should retain jurisdiction beyond January 17, 2022. If no extension motion or no motion to reinstate is filed by that date, then the dismissal will automatically convert to a dismissal with prejudice, without further action by the Court. The Court advises the parties that, generally speaking, Seventh Circuit decisions hold that dismissals "with prejudice" leave the Court without jurisdiction to enforce a settlement agreement.
