February 5, 2020 Opinion or Order Filing 7 ORDER: Plaintiff's has filed a letter #6 to explain the apparent misrepresentations in his original application for leave to proceed in forma pauperis. The rule to show cause #5 is discharged. Plaintiff says that he was unfamiliar with the process for submitting an application to proceed in forma pauperis and his mistakes were inadvertent. (Dkt. 6.) The Court accepts Plaintiff's explanation that he did not act in bad faith. Plaintiff, however, must still pay the $400 filing fee in order to proceed with the case. Plaintiff states he does not have the funds to pay the fee and that his income has decreased since the time he submitted his IFP application. But Plaintiff still receives fifty dollars each week in gifts. (Dkt. 6, pg. 2.) Given that Plaintiff is a detainee for whom the county provides the necessities of life, he had (and still has) the ability save money to pay the filing fee. Sanders v. Melvin, 873 F.3d 957, 960 (7th Cir. 2017) (noting that a prisoner "can save up... and pay the filing fee"). The Court grants Plaintiff an extension of time to pay the full statutory filing fee of $400. If Plaintiff does not pay the fee by March 31, 2020, this case will be summarily dismissed. Plaintiff may pay by check or money order made payable to Clerk, United States District Court. The Clerk is directed to mail Plaintiff a copy of this order. Signed by the Honorable Manish S.
