MINUTE entry before the Honorable Joan B. Gottschall: On 2/5/2020, plaintiffs exercised their right to amend their complaint once as a matter of course. The first amended complaint #8 dropped Easterling Wood Products Inc. ("Easterling") as a plaintiff. Two days later, Easterling filed a notice of voluntary dismissal of its claims without prejudice #9 , citing Fed. R. Civ. P. 41(a)(a)(A)(ii). Why Easterling believed it needed to take that step after the filing of the amended complaint is not clear to this court. Because plaintiffs have pleaded this case as a potential class action, their right to voluntary dismissal without a court order under Fed. R. Civ. P. 41(a)(1) is circumscribed by the rule governing dismissal of class actions, Fed. R. Civ. P. 23(e). Additionally, some courts have held that dropping a party plaintiff requires a court order in accordance with Fed. R. Civ. P. 21.
