Filing 10 ORDER: Petitioner's motion for leave to proceed in forma pauperis #4 is stricken as moot. Petitioner's motion for attorney representation #5 is granted. The Federal Defender Program for the Northern District of Illinois is appointed pursuant to the Criminal Justice Act to represent Petitioner in this proceeding. The Federal Defender Program may assign one of its attorneys or a private attorney from the Criminal Justice Act panel to represent Petitioner in this case. The appointed falls within the class of users listed in the Electronic Public Access fee schedule adopted by the Judicial Conference of the United States; therefore, the above-named attorney shall be exempt from the payment of fees for access via PACER to the electronic case files maintained in this Court for the above-captioned case only. The appointed attorney is directed to open a separate PACER account to only be used for the above-captioned case, and fees are exempt for the above-captioned case and the previous identified cases filed in this Court by this Petitioner only. The assigned attorney shall not be exempt from the payment of fees incurred in connection with other uses of the PACER system in this Court. This exemption is valid immediately and for the duration of the attorney's participation in the matter. This exemption may be revoked at the discretion of the Court at any time. The attorney shall contact the PACER Service Center at 1-800-676-6856 or via the link below to create the new PACER account and to make any necessary arrangements for the waiver. A copy of this order shall be sent to the PACER Service Center at http://www.pacer.psc.uscourts.gov/register.html. A copy of this order shall also be sent to the Systems Department of the Northern District of Illinois, to Petitioner, and to counsel. The pro se habeas corpus petition [1, 8] and motion to stay these proceeding #6 are denied without prejudice in light of the appointment of counsel. Petitioner's attorney shall confirm with his client and file an amended petition and any other relevant motion by May 8, 2020. Counsel for Respondent shall file an appearance by the same date. The parties shall also submit a joint status report by May 29, 2020: (1) detailing the current status of the state court proceedings; (2) addressing whether the Court should stay these proceedings pending the resolution of the state court proceedings; and, (3) any additional matters the parties believe is relevant. The case is set for status on June 8, 2020 at 10:00 a.m. Plaintiff may appear by phone; counsel should arrange this call. The Clerk shall provide a copy of this order to the Federal Defender Program.
