The parties also state that they are engaged in Rule 37.2 correspondence regarding written discovery issues. The parties shall continue to work together to reach a resolution regarding any written discovery issues without court intervention, including conducting a meet and confer session by telephone or videoconference. This Court closed written discovery on 5/24/22 and stated it would only permit additional written discovery based on a showing of good cause. This is because discovery in this case has been delayed significantly already, and the Court has already allowed treating physician discovery to be moved outside the fact discovery cut off of 7/31/22, which date the Court also recently extended. Thus, the Court considers requests for additional discovery in this light. As for the motion for Rule 36 requests to admit, that will be granted, and both sides will be permitted to serve a total of 25 requests to admit by 6/20/22 with responses due by 7/21/22. Requests to admit may help streamline the case, as well as answer some open questions that each side might have. As for the request by defendants to send a plethora of subpoenas to the Dekalb County Sheriff, Chicago Board of Education, CCSAO, Social Security administration and Plaintiff's cell phone providers, those requests are all denied. No good cause has been shown as to why each of these subpoenas should be sent, what information Defendants hope to obtain, and why they could not have been sent earlier. Issuing subpoenas so close to the end of a fact discovery deadline is bound to disrupt the discovery deadline as the other side often seeks to engage in counter-discovery. That will not be permitted. Indeed, the parties have much work to do between now and 7/31/22 and notably have not been able to even confirm dates for depositions, as this Court has ordered #116 . The remaining depositions and the granted requests to admit can also help close some of these alleged loose ends, to the extent there are any.
