May 1, 2020 Opinion or Order Filing 10 ORDER: The Court directs the Clerk to: (1) file Plaintiff's amended complaint #7 ; (2) issue summons for service on Defendant Warden Walter Nicholson; (3) dismiss and terminate all the remaining Defendants; and (4) send Plaintiff a blank USM-285 (Marshals service) form, a magistrate judge consent form, filing instructions, and a copy of this order. Plaintiff must complete and return a USM-285 form for service on Defendant Nicholson. The U.S. Marshal will not attempt service on Defendant unless and until the required form is received. Plaintiff also must promptly submit a change-of-address notification if he is transferred to another facility or released. If Plaintiff fails to keep the Court informed of his address, this action will be subject to dismissal for failure to comply with a Court order and for failure to prosecute. April 6, 2020 Opinion or Order Filing 6 ORDER : Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration to deduct $21.83 from Plaintiff's account for payment to the Clerk as an initial partial payment of the filing fee, and to continue making monthly deductions in accordance with this order. The Clerk is directed to send a copy of this order (electronically if possible) to the trust fund supervisor at Plaintiff's current place of incarceration and the Court's Fiscal Department. Summonses, however, shall not issue at this time as the Court dismisses Plaintiff's complaint #1 for failure to state a claim. Plaintiff is granted until June 1, 2020, to submit an amended complaint and a completed USM-285 (Marshals service) form for each Defendant named in the amended complaint. If he fails to comply, the Court will dismiss this case for failure to state a claim. Plaintiff is advised that he must promptly submit a change-of address notification if he is released or transferred to another facility. If he does not keep the Clerk apprised of his correct address, this case may be subject to dismissal.
