MINUTE entry before the Honorable Edmond E. Chang: On the motion to reassign #79 , filed by the plaintiff in JDS 1455, Inc. dba West by North v. Society Ins., 20-cv-02546 (Pallmeyer, J.), the parties in this case shall file a response by 06/01/2020. West by North may file a reply by 06/08/2020. For now, however, the Court denies in part, without prejudice, the reassignment motion as to the other cases labelled as the "Related Actions" (of course other than the one already assigned to Judge Chang). It is not at all clear that a non-party may invoke Local Rule 40.4 in this way. Local Rule 40.4(c) says that the motion "may be filed by any party to a case." The term "a case" obviously cannot mean "any" case pending in this District, and instead the rule implies that "a case" means the one that is sought to be reassigned, which would mean that only a party to that case can seek the reassignment. More practically, before burdening the parties in several other cases with potentially unnecessary briefing, it would be better to consider 20-cv-02546 first, as well as to consider the MDL-related status report to be filed by the parties in this case.
