| Filing 21 MINUTE entry before the Honorable Edmond E. Chang: The Court appreciates the details in the status report. On review of it, and because the Court generally (not always, but generally, and no reason exists otherwise here) will not require a party over its objection to attend a settlement conference, the Court adopts Bard's discovery schedule and scope (including the carry-over provisions from the MDL). So the medical-provider information is due by 06/10/2020. Plaintiff shall complete the Fact Sheet by 07/13/2020. Defendant's Fact Sheet is due by 08/10/2020. MID responses are due by 07/24/2020. ESI is due by 09/02/2020. Rule 16(b) deadline to add parties or amend pleadings is 12/14/2020. Non-party subpoenas shall be served promptly, but the deadline to do so is 12/14/2020, absent good cause (e.g., genuine surprise). Fact discovery shall close by 03/01/2021. Any retained-expert discovery will be set at a later date. Plaintiff does remain free to try to generate settlement momentum, but discovery shall commence. The status hearing of 06/11/2020 is reset to 09/16/2020 at 8:30 a.m., with a status report on discovery progress due by 09/08/2020. (mw, ) |
