A Motion to Appoint Lead Counsel was filed in the action at No. 2:19-cv-00433 on June 14, 2019. (No. 19-433, ECF No. 35.) That action, however, has since been voluntarily dismissed and was de-consolidated from the matters pending at No. 2:19-cv-00549. (No. 19-549, Order, ECF No. 20.) (2) On or before June 14, 2019, Defendants shall produce to Plaintiffs copies of: (i) the most current versions of the documents that together comprise the Kraft Heinz Savings Plan (consisting of the Kraft Heinz Savings Plan Restatement dated December 30, 2016 and copies of the First Amendment, Second Amendment, and Third Amendment thereto), (ii) resolutions appointing members to and removing members from the Employee Benefits Administration Board of Kraft Heinz ("EBAB") for the period January 1, 2017 to March 31, 2019, and (iii) the operative EBAB charter, trust agreement and all amendments, and investment policy statement, and (iv) any other preliminary discovery to which Plaintiffs are entitled under ERISA 104(b)(4), 29 U.S.C. 1024(b)(4). Nothing in this Paragraph shall prevent Plaintiffs from seeking copies of Plan documents to which they are entitled pursuant to 29 U.S.C. 1024(b)(4) or prevent Defendants and/or the Plan administrator from objecting to any such requests as beyond the scope of that section. Any such disagreements shall be promptly brought to the Court's attention after the parties meet and confer in good faith and make reasonable efforts to reach agreement as to the parameters of any such discovery.
