Fuentes: When the district court set the fact discovery cutoff in this matter at 5/14/21 and referred the matter to the magistrate judge for discovery supervision and settlement in the fall of 2020, Judge Coleman described the cutoff as a "firm date" (doc. #22 ). The parties then engaged in a months-long exchange about settlement, in which one settlement conference was scheduled, counsel for defendant(s) withdrew, new counsel appeared, and another settlement conference was scheduled and held on 4/27/21 but did not result in an agreement to settle the matter (doc. #46 ). At no time during that period did either party indicate that additional time was needed to complete discovery, including in the parties' most recent 1/8/21 status report on the progress of discovery and on their request for a settlement conference (doc. #29 ). In the meantime, plaintiff filed an amended complaint on 1/7/21 (doc. #28 ), and defendants answered on 1/21/21 (doc. #32 ). New counsel for defendants appeared on 3/2/21 (doc. #'s #39 , #40 ). In view of the foregoing, the parties are directed to confer under Rule 26(f) and file a joint written status report by noon on 5/7/21, setting forth their plan to complete discovery by 5/14/21, or their proposed agreed or contested schedule for any extension of that firm date, along with the remaining specific oral or written discovery the parties believe to be the basis for any extension. The report should further state whether any expert discovery is anticipated, and if so, a proposed agreed or contested schedule for expert disclosures and completion of depositions.
