However, this court has scheduled a hearing for 2/18/2022 to discuss with the parties their settlement efforts, particularly in light of the fact that the only hindrance to the parties' prior settlement discussions was defendants' representation that they would not be in a position to make a settlement until February 1, 2022, which has now passed. #109 . The motion #110 is premature. Defendants have not filed an answer yet because the court struck the prior deadlines for defendants to file an answer after the parties agreed to engage in a settlement conference with Judge Jantz. #93 . Moreover, the motion does not comply with the local rules. First, the plaintiff's brief in support of its motion is oversized at 27 pages. Pursuant to Local Rule 7.1, "[n]either a brief in support of or in opposition to any motion nor objections to a report and recommendation or order of a magistrate judge or special master shall exceed 15 pages without prior approval of the court." Plaintiff does not have leave of court to file a summary judgment brief in excess of 15 pages. Second, plaintiff submitted a Rule 56.1 Statement of Undisputed Material Facts containing 130 statements of fact. Pursuant to Local Rule 56.1(d)(5), "[a] movant's LR 56.1(a)(2) statement of material facts must not exceed 80 numbered paragraphs" without the court's leave. Plaintiff does not have leave to exceed this limit. Therefore, the court strikes plaintiff's motion #110 . Again, the court will discuss with the parties on 2/18/2022 their settlement efforts and will ask the parties to certify on the record whether they have engaged in good faith efforts to exhaust settlement possibilities and have in fact exhausted those possibilities. If the parties have exhausted settlement possibilities but have been unable to reach an agreement, then the court will impose a deadline for defendants to file an answer to plaintiff's Third Amended Complaint and for summary judgment motions.
