Filing 11 MINUTE entry before the Honorable Matthew F. Kennelly: Plaintiff's motion to proceed in forma pauperis is granted #4 . The Court notes that plaintiff has not filed a motion for appointment of an attorney, and in any event consideration of such a motion would be premature at this time. The Court has reviewed the complaint under 28 USC 1915(e)(2) to determine if it states a claim. Plaintiff asserts claims under the Age Discrimination in Employment Act (ADEA) and the Illinois Human Rights Act (IHRA). The only proper defendant on such claims is the employer, or in this case the prospective employer. For this reason, the Court dismisses as defendants Robert Trent Jones Jr., Robert Trent Jones Sr., Sentry Insurance Co., Karl Suopys, Victoria Henderson, Sentry Select Insurance Co., Michelle Carey, Tadas Jurgelevicius, Christopher Walther, Kunkel & Associates, and John Kraft, and directs the Clerk to terminate each of those defendants. The Clerk is directed to issue summons to the remaining defendant, KA Logistics, Inc., and the Marshal is appointed to serve KA Logistics, Inc. with summons and the complaint. The Court notes that plaintiff has already filled out a USM-285 form for KA Logistics, so the Marshal is directed to complete service using that form. The case is set for a status hearing on August 27, 2020 at 9:30 AM in Judge Kennelly's courtroom (Room 2103). Plaintiff must appear at that time, and if he does not do so the Court may dismiss the case for want of prosecution. Mailed notice. (mma, ) |
