There are two reasons for this ruling: (1) Plaintiff's motion was filed on the day that their response brief was due; and (2) the motion does not specify how many excess pages Plaintiffs seek. As to the first reason, the deadline of August 18, 2020 was the date the response brief itself was due; it was not a deadline to file an ancillary motion regarding the brief. Defendants presumably knew earlier than August 18 that they would seek to file an oversized brief, so it is unclear why the motion for leave to file an oversized brief was not submitted early enough to allow a ruling such that the brief itself could then be filed on time. As to the second reason, it is up to Plaintiffs to state how many excess pages they seek; it is not the Court's province to estimate what might be the necessary and appropriate number. Accordingly, the motion #27 is denied. Plaintiff has leave to submit, on or before 5:00 p.m. CDT on Monday, August 24, 2020, a renewed motion for leave to file excess pages that identifies the number of pages sought and provides sufficient justification for extra pages. And given that the filing deadline for the response to the motion to dismiss has passed, Plaintiff must also seek leave to file its response out of time.
