July 13, 2020 Opinion or Order Filing 35 ORDER: In accordance with Plaintiff's unopposed motion to dismiss and to remand #26 , Count III of the complaint is voluntarily dismissed and the United States is dismissed as a defendant. Plaintiff's motion #26 also asks for an order remanding the case to state court. The United States removed this case under 1442(a)(1). The United States has now been dismissed from the case, the motion for remand is unopposed, and no party has asserted an independent basis for jurisdiction. The court has no independent jurisdiction over this claim and declines to exercise supplemental jurisdiction. The motion to remand #26 is granted.
