Filing 22 REMAND with certified copy of order dated 7/22/2020 to Circuit Court of Cook County via email. (smm, ) |
Filing 21 MINUTE entry before the Honorable Virginia M. Kendall. Invoking this Court's diversity jurisdiction, Defendant Magnet-Schultz of America removed this case from the Circuit Court of Cook County on May 28, 2020. (Dkt. #1 ) Plaintiff Allied Enterprises, Inc. then moved to remand the case on the grounds that Magnet-Schultz is a citizen of Illinois and cannot remove a case filed against it in its home courts. See 28 U.S.C. 1441(b)(2). Because Magnet-Schultz is a citizen of Illinois, removal was not appropriate in this case. Magnet-Schultz recognizes that and has now stipulated to the remand. #20 The Motion to Remand #16 is granted. Pursuant to the parties' joint stipulation, each party bears its own costs. The Clerk of Court is directed to remand this case to the Circuit Court of Cook County forthwith. Civil case terminated. Mailed notice (lk, ) |
