Cox: Entry #85 is amended as follows: The Court hereby grants a protective order to Defendant regarding the subpoenas that are the subject of the recent position statements and discovery conference set for 6/30/21. Those subpoenas are untimely and need not be answered by the third parties. Although Defendant lacks standing to bring a motion to quash those subpoenas, the Court construes the objections as a motion for protective order, which is granted. See Buonavola v. L.G. Chem, Ltd., 18-cv-2802, 2019 WL 8301068, at *2 (N.D. Ill. Mar. 8, 2019). The subpoenas are clearly untimely, as this Court previously ruled that all written discovery must be served no later than 5/24/21 [DKt. 69]. Contrary to Plaintiffs' position, nothing in that order limited written discovery to only requests for production. Although the Court limited the number of RFPs the parties could exchange, it did not limit the types of written discovery that could be served; as such, interrogatories and third-party subpoenas were allowed by the Court's prior order. However, such written discovery was clearly temporally limited to being served before 5/24/21. Plaintiffs missed that deadline by almost one month. As such, the discovery is untimely and the Court grants Defendant a protective order. Regarding the identity of the client for whom Defendant performed a "click-through" agreement, Defendant must identify that client once a confidentiality order is entered in this case. Upon entry of the confidentiality order, Defendant has no valid reason to withhold that information and may instead rely on the protections in the confidentiality order. Plaintiffs are ordered to re-submit the confidentiality order to this Court's proposed order inbox consistent with this Court's prior rulings. Defendant must identify the client within 48 hours of the confidentiality order being entered by this Court. The parties are ordered to file an updated joint status report regarding replevin discovery on 7/6/21; that joint status report shall consist of one filing not to exceed 6 pages. June 8, 2021 Opinion or Order Filing 78 MINUTE entry before the Honorable Susan E. Cox: Discovery conference held. When this Court previously ruled that each "side" would be limited to 20 requests for production ("RFPs"), it was under the impression that all three Plaintiffs would answer jointly, which was a reasonable assumption given the claims in this matter and the joint representation of all Plaintiffs by the same counsel. However, Defendant served all three Plaintiffs separately with 20 identical RFPs; when Plaintiffs objected, Defendant served Plaintiffs jointly with 20 RFPs. Upon being served jointly, Plaintiffs again objected, arguing that their distinct corporate forms prevented them from responding jointly and they should be collectively limited to 20 RFPs. The purpose of this Court's prior order was to ensure that the burden of responding to RFPs was shared equally among the parties; the Court expected each party would respond to 20 RFPs. If Plaintiffs now insist that they must respond separately, the Court will allow Defendant to re-serve 20 identical RFPs on each Plaintiff; responses will be due within 21 days of the original date of service and the remainder of the Court's prior schedule remains the same. Plaintiff's Motion to Enter Confidentiality Order and to Award Fees and Costs [Dkt. 77] is granted in part and denied in part. The Court denies the motion to the extent it seeks fees and costs; Defendants positions were overruled, but substantially justified as an attempt to avoid redundant discovery costs. The Court grants the remainder of the motion over Defendant's objections for the reasons discussed in open Court. May 20, 2021 Opinion or Order Filing 69 MINUTE entry before the Honorable Susan E. Cox: The Court ordered a 6-page status report with a BRIEF history of the discovery in this matter and instead received a 7-page single-spaced screed that recited both parties' versions of the relevant facts (i.e., not the history of discovery) for several pages and over 100 pages of exhibits. The Court also ordered a proposed fact discovery deadline, and instead the parties recited the District Judge's deadline set on the limited issue of replevin. The Court is perplexed how such a simple order could be so completely mishandled. Future failure to adhere to this Court's orders and the Local Rules (see L.R. 5.2(e) (requiring double-spaced filings)) will result in the relevant filings being stricken and may lead to sanctions against the attorneys who file the non-conforming documents. Discovery on the issue of replevin must be completed by 6/30/21 per the District Judge's Order. Given the short time frame, the standard 30-day period to respond to limited written discovery relevant to the replevin issue will not suffice. A shorter time period may be ordered by the Court pursuant to FRCP 34(b)(2)(A) and FRCP 33(b)(2). The Court rules that Plaintiff should not be denied discovery on this matter and Defendant Rolston must sit for any properly noticed deposition. The Court will limit the number of requests for production for each side to 20, and sets the following schedule: 1) all written discovery regarding the issue of replevin must be served no later than 5/24/21; 2) responses to written discovery are due 21 days after service; 3) all depositions must be completed prior to 6/30/21. Defendant Roston's motion to clarify or reconsider #61 is granted in part and denied in part. First, nothing in the Court's minute order #58 abrogates the authority of the California state court. This Court expects full compliance with the California court's orders. The Court clarifies that sharing the laptops and data with the California court's forensic examiner or judicial referee strictly to comply with the California court's orders will not violate this Court's minute order #58 . Second, the Court's order permitting limited discovery was not restricted to defendant, although the Court notes that its order was not completely clear on that point. While defendant made the oral request for discovery, the Court's order granting limited discovery applies to both parties. Both parties are entitled to discovery within the parameters that Judge Cox sets. The Court notes that the deposition of the defendant, who has been accused of illegally withholding plaintiffs' property, may be particularly relevant for purposes of a motion for replevin. But again, the determination of whether Roston's deposition is within the parameters of the limited discovery is squarely within Judge Cox's authority.
