Dow, Jr: Upon review of Plaintiffs' status report #385 and the documents that have been emailed to the Courtroom Deputy and to Plaintiffs by Defendant Shah and will be uploaded to the docket in due course, the Court notes that Defendant Shah appears to have rejected any potential for settlement. Instead, he has transmitted a document titled "Motion to Dismiss," another document titled "Defence of Mudassar Shah Defendant," and a third document titled "Defendant Set of Interrogatories." These documents will remain on the docket but no action will be taken on them at this time. Instead, given that Defendant Shah is a pro se litigant, the Court will explain the proper course for Defendant Shah if he wishes to contest this case. At the last status hearing, the Court entered an order #384 granting Plaintiffs' motion for entry of an order of default. Federal Rule of Civil Procedure provides that a "court may set aside an entry of default for good cause." A party seeking to vacate an entry of default under Rule 55(c) must show: "(1) good cause for the default; (2) quick action to correct it; and (3) a meritorious defense to the complaint." Cracco v. Vitran Exp., Inc., 559 F.3d 625, 630 (7th Cir. 2009) (citations omitted). All three requirements must be met. Pretzel & Stouffer v. Imperial Adjusters, Inc., 28 F.3d 42, 46-47 (7th Cir. 1994). If Defendant Shah believes that he can meet these criteria, he may file a motion to vacate the order of default by April 6, 2021. If he files a motion, the Court will set a briefing schedule. If he does not, Plaintiffs may file a motion for default judgment at any time. If the Court denies any motion to vacate the order of default, Plaintiffs also may pursue a default judgment at any time. In the meantime, given the absence of any mutual interest in settlement and the course set out above, the telephonic status hearing set for March 18, 2021 at 9:30 a.m. is stricken and no appearances will be necessary on that date. The Court requests that Plaintiffs email a copy of this order to Defendant Shah. The Court also reminds Defendant Shah that he must file a pro se appearance as soon as possible to ensure that he receives timely notice of all court orders and filings. July 27, 2020 Opinion or Order Filing 151 MINUTE entry before the Honorable Jeffrey Cummings: Telephonic conference held on 7/27/20 regarding the status of the testing and sampling of defendants' seized products and plaintiff's emergency cross-motion to compel response to Interrogatory No. 1 concerning defendants' unfrozen assets [#109]. The Court orders as follows. Plaintiffs are ordered to provide defendants with a written update as to the results of their on-going testing of the seized products every second day beginning on 7/28/20. Plaintiffs' written update shall include the information listed in the chart on page 3 of plaintiffs' 7/20/20 memorandum (the "Chart") regarding testing [#145] plus a description of where the tested products were located within defendants' facility immediately prior to the execution of the seizure order and a narrative describing in further detail the results of testing that results in a "confirmed counterfeit" finding. Plaintiffs shall file a weekly update of their Chart with current testing results with the Court beginning on 7/31/20. With respect to the specific seized products that were tested by plaintiffs and determined to be "not counterfeit," plaintiffs are ordered to return to defendants these products pursuant to the terms of the 6/16/20 Seizure Order [#31 at 5] by 7/31/20 or within three business days of the completion of testing, whichever is later. As discussed in open court, a "not counterfeit" finding only applies only to the product or sub-set of products that plaintiffs have tested as indicated in the "Qty Recovered" column of plaintiffs' Chart. Plaintiffs will send to a laboratory selected by defendants a sample of the products with a "confirmed counterfeit" finding so that defendants can perform their own testing. Counsel for the parties are directed to meet and confer regarding the laboratories under consideration by defendants with the aim of avoiding future disputes over the capability of the selected laboratory to conduct defendants' desired testing. Plaintiffs' emergency cross-motion to compel response to Interrogatory No. 1 concerning defendants' unfrozen assets, which had previously been denied in part as moot by Judge Dow's 7/20/20 order, is granted in part. Upon review of today's filings [77, 78] regarding testing and return of seized inventory, it appears that both the volume of seized products and the organization of Defendants' inventory present significant challenges in devising a protocol for ensuring the twin aims of (a) protecting the public from the sale of counterfeit items from Defendants' stock while (b) enabling Defendants to run the legitimate aspects of their business. It is not uncommon in litigation especially where a request for preliminary injunctive relief is involved to rely on sampling to examine a fraction of the documents or tangible items involved in the litigation from which the parties and the Court can extrapolate to draw relatively reliable conclusions, subject of course to confirmation or rejection as the case moves forward. The notion that discovery should be proportional to the needs of the case at every stage is enshrined in the Federal Rules of Civil Procedure and that notion certainly applies here, where testing every item would be impracticable over the next six weeks before the preliminary injunction hearing or at any other stage of the case. But the parties must speak a common language to reach a workable protocol. Today's filings show that they are not there, despite thIs Court's wishful thinking for an agreed order. This issue is referred to Magistrate Judge Cummings so that he can assist counsel in defining and narrowing the parameters for a sensible testing regime. Upon review of today's filings [77, 78] regarding testing and return of seized inventory, it appears that both the volume of seized products and the organization of Defendants' inventory present significant challenges in devising a protocol for ensuring the twin aims of (a) protecting the public from the sale of counterfeit items from Defendants' stock while (b) enabling Defendants to run the legitimate aspects of their business. It is not uncommon in litigation especially where a request for preliminary injunctive relief is involved to rely on sampling to examine a fraction of the documents or tangible items involved in the litigation from which the parties and the Court can extrapolate to draw relatively reliable conclusions, subject of course to confirmation or rejection as the case moves forward. The notion that discovery should be proportional to the needs of the case at every stage is enshrined in the Federal Rules of Civil Procedure and that notion certainly applies here, where testing every item would be impracticable over the next six weeks before the preliminary injunction hearing or at any other stage of the case. But the parties must speak a common language to reach a workable protocol. Today's filings show that they are not there, despite thIs Court's wishful thinking for an agreed order. This issue is referred to Magistrate Judge Cummings so that he can assist counsel in defining and narrowing the parameters for a sensible testing regime.
