Filing 27 MINUTE entry before the Honorable Robert M. Dow, Jr: Upon review of the briefs filed on Plaintiffs' motion for TRO #4 , the Court sets this matter for a telephonic hearing on 7/17/2020 at 9:30 a.m. The briefing indicates a number of issues where the parties appear to be in or close to agreement, but there are a few lingering issues in dispute. The Court has some ideas for potential agreement on the lingering issues that it believes would be in the parties' interest to explore, given (1) the prior attempts to resolve these issues, (2) the temporary nature of the requested relief (14 days, extendable once to 28 days absent agreement to extend further), (3) the nature of any relief that could be granted at the next stage (a non-final, immediately appealable preliminary injunction), and (4) the cost of further litigation. If a resolution cannot be obtained by the end of the hearing, the Court will be in position to rule on the TRO motion by early next week in any event. Please use the Court's toll-free call-in number 877-336-1829, conference access code is 6963747. Mailed notice (cdh, ) |

No motions may be noticed for in-person presentment; the presiding judge will notify parties of the need, if any, for a hearing by electronic means or in-court proceeding. See attached Order. Filing 18 RESPONSE by Defendant Helen Sun (Austermuehle, Patrick) |
Filing 16 STATUS Report (Joint Status Report on Plaintiff's Motion for TRO) by Stats LLC (Schilling, Jennifer) |
Filing 15 MINUTE entry before the Honorable Robert M. Dow, Jr: Upon review of the joint status report #14 filed on 7/2/2020, the Court accepts the parties' proposal that (1) they file an agreed order on 7/6/2020 if they reach an agreement that would eliminate the need for briefing and ruling on Plaintiff's TRO motion #4 and (2) if they are unable to reach final terms, briefing on the TRO motion will be extended by two days for each party. The Court requests that counsel either file an agreed order or a status report on 7/6/2020 to confirm which path they are on. If a telephonic hearing is necessary, it will need to take place either on 7/14 or 7/17 if the "A" and "B" schedule for judges remains in place that week. The Courtroom Deputy will contact counsel by email with a specific date and time if a hearing is necessary. Mailed notice (cdh, ) |
Filing 14 STATUS Report Jointly Filed by Helen Sun (Austermuehle, Patrick) |
Filing 17 DOCUMENT ENTERED IN ERROR. Modified on 7/8/2020 (cdh, ). |
Filing 13 MINUTE entry before the Honorable Robert M. Dow, Jr: Defendant's motion to postpone hearing on Plaintiff's emergency motion for TRO #11 is denied in part as a telephone hearing will go forward at 10:30 a.m. tomorrow morning, 6/30/2020. With that said, the hearing will be strictly procedural to set a schedule for briefing and further hearing if one is necessary, and Defendant will be given a reasonable amount of time to file a written response. In view of the points made in paragraph 7 of the motion, and confirmed by the exhibits to the complaint, this is an appropriate issue for expedited treatment, but not true emergency treatment. Counsel for both sides are directed to use the following dial-in information for the telephone hearing: Toll-free dial-in number is 877-336-1829, conference access code is 6963747.
