August 20, 2020 Opinion or Order Filing 6 ORDER The Court has previously completed its initial review of Plaintiff's complaint and recruited counsel to represent Plaintiff. Dkt. 5. The Court writes separately to document the following. The Court has ascertained from the complaint that Cook County Jail detainee Michael Hughes (no relation, it appears, to Plaintiff), inmate number #2015-1106050, drafted the complaint in this case on behalf of Plaintiff. On March 17, 2020, this Court found that Michael Hughes had perpetrated a fraud upon the court by purposefully diverting assets to other detainees' trust fund accounts in order to avoid making installment payments towards his approximately $5,000 obligation in amassed filing fees, and this Court therefore dismissed Michael Hughes' then-pending actions with prejudice. See Case Nos. 18-cv-5582, 18-cv-5895, 18-cv-6138, 18-cv-6139, 19-cv-1791, 19-cv-2457, 19-cv-3282 and 19-cv-6469. In light of Michael Hughes' fraudulent conduct, on July 15, 2020, the Executive Committee barred Michael Hughes from filing new civil actions in this District without the Committee's prior approval. See Case 20 C 4102. The trust fund account statement that Plaintiff has submitted here with his in forma pauperis application shows three deposits of funds from Michael Hughes' relatives into Plaintiff's account in April 2020. Dkt. 3, pg. 4 (deposits from Antonio and Yesmi Hughes). This is precisely the fraudulent, unlawful conduct that Michael Hughes was sanctioned for just the month prior. The Clerk of Court is ordered to send a copy of this order to detainee Michael Hughes, #2015-1106050, at the Cook County Jail, and to the Executive Committee so it may take whatever further action is deemed just and appropriate. August 6, 2020 Opinion or Order Filing 5 ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration to immediately deduct $34.33 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee and to continue making monthly deductions in accordance with this order. However, summonses shall not issue at this time. Plaintiff's complaint #1 is dismissed without prejudice for misjoinder. The Court grants Plaintiff's motion for attorney representation #4 and recruits Jack Vrett, Honigman LLP, 155 N. Wacker Dr. Suite 3100, Chicago, IL 60606, jvrett@honigman.com, to represent Plaintiff in accordance with counsel's trial bar obligations under N.D. Ill. Local Rules 83.11(h) and 83.37.1 By August 27, 2020, counsel shall file a status report indicating how he intends to proceed in this case. If counsel believes that proceeding with the representation would be inconsistent with his Rule 11 obligations, he should so inform the Court.
