The parties report that Plaintiff and Defendant Nova Wildcat Shur-Line, LLC ("Nova") have reached a settlement. By 05/31/2021, the parties are to file a stipulation of dismissal or, to the extent the settlement is still being finalized, a joint status report updating the Court on when the settlement will be finalized and a reasonable deadline for the filing of a stipulation of dismissal. The Court also notes the settlement conference scheduled for 05/05/2021 between Plaintiff and Defendant Enviro Tech International Inc. #226 . As to the remaining defendants, the parties note that Plaintiff and Defendants Naval Facilities Engineering Command and the United States Department of Energy request an extension of the current fact discovery deadline from 05/30/2021 #225 to 06/30/2021. In light of the fact that the parties have not undertaken or devised a plan for any oral discovery, the Court finds that an extension of the fact discovery deadline is warranted. Fact discovery to be completed by 06/30/2021. The Court expects the parties to work together to proceed with any remaining fact discovery so as to meet this deadline.
