Filing 8 ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration to deduct $25.46 from Plaintiff's account for payment to the Clerk of Court as an initial partial filing fee in this case and to continue making monthly deductions in accordance with this order. The Court directs the Clerk of Court to send a copy of this order (electronicallyif possible) to the trust fund officer at the facility having custody of Plaintiff and to this court's fiscal department. Summonses, however, shall not issue. Plaintiff's complaint #1 is dismissed without prejudice for failure to state a claim upon which relief can be granted. Plaintiff is given until October 2, 2020 to submit an amended complaint and a completed USM-285 (Marshals service) form for each Defendant named in the amended complaint. If Plaintiff does not comply with this order, the Court will dismiss Plaintiff's lawsuit with prejudice for failure to state a claim. Plaintiff also must promptly submit a change-of-address notification if he is transferred to another facility or released. If Plaintiff fails to keep the Court informedof his address, this action may be subject to dismissal for failure to comply with a Court order and for failure to prosecute. Plaintiff's motion for attorney representation #4 is denied without prejudice. The Clerk is directed to send Plaintiff an amended civil rights complaint form and instructions, a blank USM-285 form, and a copy of this order. Signed by the Honorable John F. Kness on 8/21/2020.
