Filing 5 MINUTE entry before the Honorable Manish S. Shah: Petitioner Maurice Johnson has filed a 28 U.S.C. 2254 petition challenging his 2003 Will County conviction for murder (Case No. 02 CF 1519). This is Johnson's second 2254 petition challenging his conviction. His first petition was dismissed with prejudice. See Johnson v. Gaetz, No. 10 C 1373 (N.D. Ill. Sept. 22, 2010). Before Johnson can bring a second or successive 2254 petition, he must "move in the appropriate court of appeals for an order authorizing the district court to consider the [ 2254] application." 28 U.S.C. 2244(b)(3). Accordingly, Johnson's current 2254 petition is dismissed without prejudice to him submitting it after he obtains permission from the Seventh Circuit Court of Appeals to file it. See Seventh Circuit Rule 22.2. Terminate civil case. Notices mailed. (psm, ) |
